“Comprehensive Guide to the Terms and Conditions for Our Affiliates"
🔘 General
These Terms and Conditions (the "Affiliate Agreement") govern the Affiliate Program that is made available by Earn2Trade LLC. ("Earn2Trade", "we" or "us"). These Terms and Conditions represent the whole agreement and understanding between Earn2Trade and the individual or entity who participates in the Affiliate Program (the "Affiliate", or "you").
Please read this agreement carefully as it represents a legally binding agreement between you and Earn2Trade. By submitting your application and by your use of the Affiliate Program, you agree to comply with all of the terms and conditions set out in this Affiliate Agreement. Earn2Trade may terminate your Affiliate Account at any time, with or without notice, for conduct that is in breach of this Affiliate Agreement, for conduct that Earn2Trade believes is harmful to its business, or for conduct where the use of the Affiliate Program is harmful to any other party.
🔘 Referral Tracking
Earn2Trade will provide the Affiliate with specific Referral Links with an APID (affiliate page ID) to link advertisements and other marketing content to Earn2Trade. Earn2Trade will track users who have visited these Referral Links using cookies which expire after 90 days from the day they were first clicked.
After this 90-day period, the APID will still be assigned to that same customer, but it will be overwritten in case this same customer clicks on another affiliate link. After the 90-day period, cookies will be replaced in case the customer uses a coupon from a different affiliate. Only users who make a purchase while the cookie is active will be considered referrals of the Affiliate and recorded as such in the Affiliate Dashboard.
The Affiliate is not authorized to modify or alter the Referral Links or the cookies in any way. Earn2Trade is not responsible for any tracking or reporting errors that may result from any modifications to the Referral Link or the cookies.
🔘 Affiliate Fees and Payouts
A referral will become eligible for payout ("Eligible Referral") at the end of the next calendar month if it meets all of these criteria:
i. The referral makes a purchase or repurchase of a subscription of the Beginner Crash Course, Gauntlet Mini™ or Trader Career Path programs.
ii. The referral's account remains active and in good standing.
iii. The referral's account has not had any of its payments refunded, charged back or otherwise reversed.
Failure to meet any of these criteria will permanently void the referral and disqualify the referral from any potential payouts.
The Affiliate is entitled to receive a one-time payment or a revenue share payment based on the agreement between the affiliate and Earn2Trade for every eligible Referral that is recorded in the Affiliate Dashboard ("Affiliate Fee"). Affiliate Fees will be payable only when the Affiliate has at least 5 Eligible Referrals that are pending payout.
All Affiliate Fee payments will be payable in United States Dollars only, except as otherwise determined by Earn2Trade in its sole discretion. Payment will be made through PayPal against a valid invoice issued by the Affiliate using the invoice generation and submission tool located in the Affiliate Dashboard. The Affiliate is responsible for providing Earn2Trade with the full and accurate details that are required to remit the Affiliate Fees, and is solely responsible for any delays in payment resulting from its failure to do so.
Referrals will become void, and any unpaid Affiliate Fees will be forfeited, after 12 calendar months. In the event of any activity deemed suspicious by Earn2Trade, Earn2Trade may delay the payment of Affiliate Fees by up to 6 calendar months to verify the relevant transactions. Earn2Trade reserves the right to recalculate, void, or disqualify any referrals or Affiliate Fees in the event of any fraudulent, deceptive or otherwise illegal activity.
Referrals for purchases made through Earn2Trade promotional or special offers are not eligible for payout.
🔘 Advertisements
Earn2Trade hereby grants the Affiliate a non-exclusive, non-transferable, limited license to use the Earn2Trade logos for the sole purpose of promoting our service within the context of the Affiliate Program. This license will expire upon termination of the Affiliate's participation in the Affiliate Program.
The Affiliate may only display advertisements that contain Earn2Trade's logos or service marks in good taste. The Affiliate may not use Earn2Trade's logos or service marks in a manner that, in Earn2Trade's sole discretion, portrays Earn2Trade in negative light.
The Affiliate will be solely responsible for its own marketing activities. All marketing activities must be professional and in full compliance with all applicable laws.
Earn2Trade may, without prior notice, require the Affiliate to remove or modify any advertisements in Earn2Trade's sole discretion.
🔘 Termination
The Affiliate may terminate the Affiliate's participation in the Affiliate Program with immediate effect by giving the other party a written notice of termination. Earn2Trade reserves the right to terminate the Affiliate's participation in the Affiliate Program at any time for conduct that is in material breach of this Affiliate Agreement or for conduct that Earn2Trade, in its sole discretion, deems to be harmful to its business or any third party. Upon termination, the Affiliate will lose access to its Affiliate Dashboard and will forfeit all potential or unpaid Affiliate Fees.
🔘 Relationship of Parties
Earn2Trade and the Affiliate are independent contractors. Nothing in this Affiliate Agreement will create any partnership, employment, representative, agency, or joint venture relationship between the parties. The Affiliate has no authority to act on Earn2Trade's behalf.
🔘 Limitation of Liability
The Affiliate Program is provided on an "as is" and "as available" basis and the use of the Affiliate Program is at the Affiliate's own risk. Earn2Trade makes no representations or warranties, either expressed or implied, with respect to the Affiliate Program, or any service or information provided through the Affiliate Program. Earn2Trade is not responsible for any damages, injury or economic loss arising from the use of Affiliate Program. Should any part of the Affiliate Program cause damage or inconvenience to the Affiliate or anyone claiming through the Affiliate, the Affiliate assumes responsibility and the entire cost for them.
The Affiliate will indemnify and hold harmless Earn2Trade, its directors, officers, employees, agents, subsidiaries, and third parties from and against any losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses (including reasonable related expenses, legal fees, costs of investigation) arising out of or relating to the Affiliate's or any third party's operations or use of the Affiliate Program.
🔘 Modification
Earn2Trade may, in its sole discretion, change or modify this Affiliate Agreement at any time, with or without notice. Such changes or modifications shall be made effective for all Affiliates upon posting of the modified Affiliate Agreement to this web address: http://www.Earn2Trade. The Affiliate is responsible for reading this document from time to time to ensure that its use of the Affiliate Program remains in compliance with this Affiliate Agreement. If any modification is unacceptable to the Affiliate, its sole recourse shall be to terminate this Affiliate Agreement. The Affiliate's continued participation in the Affiliate Program will constitute binding acceptance of such modifications.
🔘 Miscellaneous
The Affiliate warrants and represents that it is over the age of 18 and is qualified to enter into this Affiliate Agreement. The Affiliate warrants and represents that its actions and its participation in the Affiliate Program are in compliance with all applicable laws, rules, regulations, and any requirements of governmental authority at all times. Earn2Trade reserves the right to terminate the Affiliate's participation in the Affiliate Program if Earn2Trade determines, in its sole discretion, that the Affiliate's actions or its participation in the Affiliate Program is in violation of any laws, rules, regulations, or any requirements of governmental authority. This Affiliate Agreement constitutes the entire understanding between Earn2Trade and the Affiliate. This Affiliate Agreement supersedes any other contracts or understandings between the parties hereto and neither party shall be bound by any statements or representations that are not embodied in this Agreement.
Any dispute arising in relation to this Affiliate Agreement shall be exclusively resolved in the Courts of the State of Wyoming in the United States of America.
🔘 Lifetime Commissions
Lifetime commissions are a key component of the Earn2Trade Affiliate Program. In this commission structure, the Affiliate is entitled to receive commissions for the life of the customer, as long as the customer continues to purchase the product or service.
Here's how it works:
i. Once the referral becomes an Eligible Referral and makes their first purchase through the Affiliate's referral link, the Affiliate will be eligible to receive lifetime commissions.
ii. The Affiliate will continue to earn a commission for every subsequent purchase the customer makes, as long as the customer remains active and in good standing.
iii. The commission does not only apply to the initial product or service the customer purchased but extends to all subsequent purchases the customer makes on Earn2Trade.
iv. There is no expiry on these lifetime commissions. As long as the customer continues to make purchases on Earn2Trade, the Affiliate will receive a commission. However, if the Affiliate ceases to make direct sales for 3 consecutive months, the lifetime commissions will cease.
v. All lifetime commissions are subject to review and final approval by Earn2Trade.
vi. The specific percentage of the lifetime commission and other details will be based on the agreement between the affiliate and Earn2Trade.com. The Affiliate can review this information in the Affiliate Dashboard.
vii. The Affiliate is responsible for keeping their Affiliate Dashboard details up-to-date to ensure the proper tracking and payment of lifetime commissions.
By participating in the Earn2Trade.com Affiliate Program and receiving lifetime commissions, the Affiliate agrees to abide by these terms.
Please note that these are hypothetical terms and conditions for lifetime commissions and should be adjusted to reflect the actual business model and policies of Earn2Trade.com
🔘 Prohibited Affiliate Practices
Affiliates are strictly prohibited from employing dishonest or misleading practices, including but not limited to, the use of misleading advertising or coupon strategies such as claiming to offer higher discounts than those officially provided by Earn2Trade. Additionally, affiliates are expressly forbidden from using Google Ads, Bing Ads, or Yahoo Ads to promote their affiliate business using the company keywords, such as: Earn2Trade, Earn to trade, Earntotrade, E2T, Earn 2 Trade, or any variations that make reference to the company. Other keywords are allowed.
Affiliates should not use the company name in ad titles or content, nor should they mislead users into believing they are accessing Earn2Trade's official website when in reality they are being directed to an affiliate link.
If Earn2Trade determines, at its sole discretion, that an Affiliate has engaged in such activities, a warning will be issued to the Affiliate. If, after receiving a warning, the Affiliate fails to update their advertising information to accurately reflect the discounts and offers provided by Earn2Trade, or continues to use Google Ads for their affiliate links, Earn2Trade reserves the right to disable the Affiliate's link and terminate their participation in the Affiliate Program.
Affiliates are reminded that they bear the sole responsibility for ensuring their advertisements and promotional practices are compliant with all relevant laws and regulations. Any Affiliate found to be in violation of these requirements may face immediate termination from the Affiliate Program, forfeiture of any pending or unpaid Affiliate Fees, and further legal action as deemed necessary by Earn2Trade.
Affiliates must always ensure that their actions and participation in the Affiliate Program uphold the reputation and brand image of Earn2Trade. Affiliates must avoid any actions that could potentially damage the Earn2Trade brand or lead to revenue loss.
Earn2Trade is not responsible for any loss or damage arising from the use of unauthorized or falsely advertised coupons that are not officially issued by Earn2Trade. The Affiliate agrees to hold Earn2Trade harmless against any claims, damages, or expenses arising from the use of such coupons.
Any dispute arising in relation to this clause will be exclusively resolved in the Courts of the State of Wyoming in the United States of America.
Please note that violation of these terms, especially the use of Google Ads for promoting affiliate links, can result in the termination of the Affiliate contract.
